Kerala Patent Support Scheme objectives

In an effort to promote entrepreneurship and creativity in the state, the government of Kerala has introduced the Kerala Patent Support Program, which would pay startup companies and students’ expenses for obtaining national and worldwide patents for their ideas. This action is a component of a larger effort in Kerala to promote an innovative and inventive problem-solving culture. The initiative, which will apply to all patent applications submitted by registered patent lawyers after November 9, 2015, aims to promote innovation and entrepreneurship by utilizing the excellent resources and assistance offered by the state. Kerala Patent Support Scheme Benefits

  • The scheme’s first and most significant benefit is the payment of Rs 2 lakhs for each Indian patent and Rs 10 lakhs for each international patent.
  • The following services are not included: Provisional Patent Filings, Patent Search, Drafting, and Filing, Claims Preparations, Fast Tracking Fees, Claims Prosecutions and Granting Activities of Prosecution against Appellate Authorities who have Already Rejected Your Claims for Valid Reasons and Both are not patent renewals.
  • Copyrights, trademarks, or any other type of intellectual property right are not supported by the proposal; only patents are.

 

Application Submission Time for Kerala Patent Support Scheme

Entrepreneurs and student innovators that meet the eligibility requirements can submit their applications online through the KSUM website. Registration will be accessible each day. Applications received before the 20th of every month will be processed within that month; those received after the 20th will be carried over to the next month to be processed.

 

KSUM Patent Support Scheme Eligibility

  • Only patent applications submitted after November 9, 2015, will be taken into account.
  • The proprietorship or limited liability partnership type of legal structure should be employed in the event of a new business.
  • Schemes are not open to innovators.
  • If they fit the criteria, student entrepreneurs may submit a direct application through their IEDC for patent financing.
  • Only those students who are actively pursuing their academic goals will be eligible to receive financial aid.
  • The new firm must be registered in Kerala within ten years of the date it was founded, and it must have both a DIPP and a Udyog Aadhar number.
  • The Scheme does not give financial support for patent renewals and will only grant financial assistance to students who are actively pursuing their academic goals.
  • Legal proceedings brought against judicial review authorities that have previously rejected a person’s patent claims are not financially supported by the scheme.

 

Documents required for Kerala Patent Support Scheme Startups

  • Paper copies of the original invoice and receipt.
  • The original bank statement details the amount transferred.
  • A concise summary of the concepts or claims being patented.
  • A copy of the provisional patent certificate.
  • You will receive a patent certificate if you are granted a patent.
  • Modifications, copies of the patent application, early review, early publishing, and early publication.
  • Particulars on proof of residency
  • A copy of the assigning and assignor agreement, if there is one, as well as the necessary paperwork for beginning a business
  • In the case of the original inventor transferring technology to the startup, a NOC from the original inventor for reimbursing patent cost to the startup is to be furnished.
  • In case the patent is filed before forming or registering the company, then such patent costs are reimbursed to startups, where the filed patent idea or technology is being pursued by the startup for building a business.
  • Undertaking that the startup has not so far claimed and will not claim patent reimbursement costs from any other organizations/ govt. bodies and if found, they will pay twice the amount to KSUM, which is reimbursed through the patent support scheme
  • Canceled Cheque of the company and Bank details (Branch name, IFSC Code)

 

Processes of the Kerala Patent Support Scheme

There are 4 processes of the scheme. They are:

  • Step 1 – Application Process:
  • Step 2 – Hard Copy Submission

After submission of online application Hard Copy of the following documents should be submitted to KSUM – Originals of Invoice & Receipts by an authorised/ recognised IP Consultant, Bank Statements verified by Bank Manager. The documents can either be couriered or submitted to any KSUM Offices. Refunded within 15 working days based on the complete hard documents received at KSUM Office.

  • Step 3 – Verification and Processing

After successful completion of Steps 1 and 2, one on one call with KSUM representative is initiated. On confirmation of completeness of documents, the necessary e0file approval process is initiated.

  • Step 4 – Fund Release

On successful verification of documents, an E-file approval is taken for reimbursement by the KSUM representative. The disbursement will be done in the form of a Treasury Cheque in the name of the Startup/student innovator.

  • An original hard copy of the invoice and receipt for the consultation fees, and IPR fees with the seal and signature of IPR India.
  • The original bank statement, which includes the attested money transfer statement.
  • A letter of recommendation from the IEDC attesting to the project’s validity.
  • A concise summary of the patent-applicable concepts or claims A copy of the provisional patent certificate if any.
  • Patent certificate, in the event, that a patent is obtained.
  • Copies of the patent application, early publication, early examination, amendments to the original application, or a receipt from IPR.
  • Details of Residence Proof.
  • A letter from the college, signed by the principal or another person of similar authority, attesting that the applicant is currently enrolled at the school.
